Life after divorce is full of just as much, if not more change than before. Because of this, revisiting the terms of a divorce long after the divorce itself is not uncommon. In terms of child custody, parental relocation, and Florida law however, there are specific factors that the courts will consider in determining whether or not the custodial parent can relocate the child.

Custody, Parental Relocation and Florida Law

In my practice as a family law attorney, I represent parents with primary residential custody who are seeking permission to relocate with their child, AND parents with secondary residential custody seeking to oppose their former spouse's proposed move. Recently, the Florida legislature enacted a new statute that increases the number of factors courts consider in these 'move-away' cases from six, to eleven. These factors include:

  • Is the proposed move in the best interest of the child?
  • What are the needs of the child and what impact will the proposed move likely have on their development?
  • What is the child's preference?
  • Will the custodial parent's relocation significantly improve the quality of life for both themselves and the child?
  • Has the custodial parent complied with current visitation rights and are they likely to comply with new arrangements if allowed to relocate?
